The purpose of these acts is to protect homeowners from unscrupulous contractors taking advantage, taking money, and doing no work or terrible work. In some states, such as New Jersey, HIA violations can result in treble damages, attorneys fees, and forfeiture of the right to payment. While the HIAs are strict and written to heavily favor and protect homeowners, many interpretations by the Courts have softened the blow for contractors.<\/span><\/p>\n<p><span style=\"font-family: inherit;\">A recent case in Connecticut did not follow that trend. The case of <a href=\"http:\/\/caselaw.findlaw.com\/ct-supreme-court\/1854030.html\" target=\"_blank\" rel=\"noopener\">Burns v. Adler, 325 Conn. 14<\/a>, 155 A.3d 1223 (2017) related to a <\/span><span style=\"font-family: inherit;\">contractor<\/span><span style=\"font-family: inherit;\">&#8216;<\/span><span style=\"font-family: inherit;\">s<\/span><span style=\"font-family: inherit;\"> action against a homeowner (HO), arising from home improvement services on a residential renovation project.\u00a0The contractor sued the homeowner for a balance due for work performed on the home, including an action for foreclosure on a <a href=\"https:\/\/www.lienitnow.com\/connecticut-faq\" target=\"_blank\" rel=\"noopener\">Connecticut Mechanic&#8217;s lien<\/a>. The contractor further alleged that the homeowner acted in bad faith in not paying the amounts due and owing. <\/span><\/p>\n<p><span style=\"font-family: inherit;\">In response, the\u00a0homeowner\u00a0claimed that the enactment of the Home Improvement Act, <\/span><a href=\"https:\/\/www.lawserver.com\/law\/state\/connecticut\/ct-laws\/connecticut_statutes_20-429\" target=\"_blank\" rel=\"noopener\" data-filters=\"custom: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\" data-func=\"LN.Advance.ContentView.runTableCaseSearch\" data-pctpgu=\"data-pctpgu\" data-searchpath=\"\/shared\/contentstore\/statutes-legislation\" data-searchtext=\"Conn. Gen. Stat. \u00a7 20-429 (Rev. to 2007)\"><span style=\"font-family: inherit;\">Conn. Gen. Stat. \u00a7 20-429 (Rev. to 2007)<\/span><\/a><span style=\"font-family: inherit;\">, specifically removed a rule previously created by the courts that allowed judges and juries to\u00a0consider whether a\u00a0HO acted in bad faith.<\/span><\/p>\n<p><span style=\"font-family: inherit;\">The Court held that Judgment for the HO was warranted\u00a0dismissing the <\/span><span style=\"font-family: inherit;\">contractor<\/span><span style=\"font-family: inherit;\">&#8216;<\/span><span style=\"font-family: inherit;\">s<\/span><span style=\"font-family: inherit;\"> breach of contract claim and request for judgment of strict foreclosure on a mechanic&#8217;<\/span><span style=\"font-family: inherit;\">s<\/span> <span style=\"font-family: inherit;\">lien.\u00a0 The court held that the\u00a0<\/span><span style=\"font-family: inherit;\">parties&#8217; contract did not comply with the Act and the bad faith exception was inapplicable in the circumstances (notably the court did not get rid of the bad faith exception, but rather held that it did not apply to the facts presented to it).<\/span><\/p>\n<p><span style=\"font-family: inherit;\">In holding that the HO was not required to pay the contract, the court relied mainly on the CT HIA.
