{"id":967,"date":"2012-07-12T13:48:00","date_gmt":"2012-07-12T13:48:00","guid":{"rendered":"https:\/\/www.lienitnow.com\/blog\/index.php\/2012\/07\/12\/epa-announces-stormwater-enforcement-settlement-with-toll-brothers\/"},"modified":"2017-12-13T19:40:44","modified_gmt":"2017-12-13T19:40:44","slug":"epa-announces-stormwater-enforcement","status":"publish","type":"post","link":"https:\/\/www.lienitnow.com\/blog\/2012\/07\/epa-announces-stormwater-enforcement.html","title":{"rendered":"EPA Announces Stormwater Enforcement Settlement with Toll Brothers"},"content":{"rendered":"<div>USEPA <a href=\"http:\/\/yosemite.epa.gov\/opa\/admpress.nsf\/d0cf6618525a9efb85257359003fb69d\/3f7e2d8a276ec4b285257a2300607c35!OpenDocument\" jquery1710874252448571452=\"8\" target=\"_blank\">announced<\/a> that it has settled a stormwater enforcement case against Toll Brothers, one of the largest home building companies in the United States.&nbsp;This case is one of a series of stormwater enforcement cases targeting residential developers and big-box retailers for violations of construction stormwater regulations.&nbsp;While this <a href=\"http:\/\/www.epa.gov\/oecaerth\/data\/planning\/priorities\/cwastorm.html\" jquery1710874252448571452=\"9\" target=\"_blank\">enforcement priority<\/a> has been in place for a while, the Toll Brothers case reflects USEPA\u2019s continued dedication to target construction stormwater violations for enforcement.<br \/>&nbsp;The <a href=\"http:\/\/www.epa.gov\/compliance\/resources\/cases\/civil\/cwa\/tollbrothers.html\" jquery1710874252448571452=\"10\" target=\"_blank\">settlement<\/a> resulted from over 600 alleged violations of stormwater regulations by Toll Brothers on numerous construction sites, which resulted in increased pollution from stormwater runoff.&nbsp;The settlement calls for Toll Brothers to pay $741,000 to resolve the claims against it.&nbsp;It also implements a compliance program, which requires Toll Brothers to provide for dedicated management oversight and employee training regarding stormwater compliance, and to routinely inspect construction sites to minimize stormwater runoff.&nbsp;Toll Brothers must also develop site-specific pollution prevention plans for each construction site, and track and submit to USEPA stormwater related data.&nbsp;The structure of this settlement is very similar to consent decrees USEPA has negotiated in previous construction stormwater cases.<br \/>The Toll Brothers case is a reminder to developers and big-box retailers that they should consider auditing their stormwater compliance programs at construction sites.&nbsp;Recent economic pressures may invite cutting corners on regulatory compliance, particularly on matters such as stormwater that may be viewed as unimportant.&nbsp;USEPA does not share that view, however &#8212; stormwater is considered a principal threat to water quality and therefore it remains an enforcement priority.&nbsp;Even if compliance short-cuts are taken by construction contractors without the owner&#8217;s knowledge, USEPA may deem the owner responsible for the non-compliance.<br \/>A list of Clean Water Act settlements <a href=\"http:\/\/cfpub.epa.gov\/compliance\/cases\/index.cfm?templatePage=12&amp;ID=3\" jquery1710874252448571452=\"11\" target=\"_blank\">can be found on the USEPA website<\/a>.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>USEPA announced that it has settled a stormwater enforcement case against Toll Brothers, one of the largest home building companies in the United States.&nbsp;This case is one of a series of stormwater enforcement cases targeting residential developers and big-box retailers for violations of construction stormwater regulations.&nbsp;While this enforcement priority has been in place for a [&hellip;]<\/p>\n","protected":false},"author":3,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1653,1657,1654,1656,1655],"tags":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v21.8 -
